Administrative Adjudication

The Village of Glen Ellyn’s Administrative Adjudication process addresses a wide range of non-compliance issues involving violations of the Village Codes and Ordinances. Code Enforcement citations issued by the Village were previously heard in the DuPage County Circuit Court. In 2017, the Village adopted a process to handle code enforcement violations through an Administrative Adjudication process overseen by an Administrative Adjudication Hearing Officer.

By conducting these hearings at the Civic Center it expedites resolution, reduces litigation expense and provides a local forum for hearing civil court violations. An administrative hearing is a civil not a criminal proceeding. Cases are punishable by fines and penalties that are listed in the Village Code.

  • Fire Code violations
  • Property Maintenance violations
  • Work exceeding the scope of a permit
  • Work without a permit
  • Zoning Code Violations

Citation

A Village Inspector may issue a citation against an individual or a corporation. A citation may also be initiated following a citizen complaint. The citation will include the date, location, offense and mandatory hearing date and time along with code excerpts, photos and any other proof of a violation.  If you receive a citation ordering you to appear at a hearing before the Village of Glen Ellyn’s Administrative Adjudication Hearing Officer, you and/or your representative must be present on the date and time specified. If English is not your first language, you must bring someone to assist you.

Hearing

All hearings are held at the Village of Glen Ellyn Civic Center, Galligan Board Room, 3rd floor, 535 Duane Street, Glen Ellyn, IL and start promptly at 1:00 P.M. Plan to arrive a few minutes early, check in with the Bailiff, and take a seat until your case is called.

If the citation was issued to a corporation, an attorney needs to appear as the corporation representative. An Appearance for Respondent form, which is included in the citation packet, needs to be sent to the Village Administrative Adjudication Clerk no later than 3 days prior to the hearing date.

The Hearing Office will make an opening statement and call the first case. The hearing will begin immediately and both sides will be given an opportunity to present testimony and evidence. The Village is responsible for presenting its case and must proceed first. You have the right to tell the Hearing Officer your side of the story. This includes using witnesses and physical evidence such as bills, receipts, and photos. All documents presented will be retained by the Administrative Adjudication clerk and entered as evidence.

If you or your representative fail to appear for a scheduled hearing, you are in default, and may be found liable in your absence. You will then be subject to any and all fines or penalties.

If you are in default on a matter, you have 21 days to request a new hearing. To request a new hearing or a Motion to Vacate Default Judgment form, call 630-547-5250.

After the conclusion of the testimony from each side, the Hearing Officer will make a final written determination on the basis of evidence. If the Hearing Officer finds that the Village has proven its case, the respondent will be found liable and the Hearing Officer will proceed to set matters of compliance, fines and other costs that may be imposed as set forth in the Village Code. All judgments are final and enforceable by law and all fines are made payable to the Village of Glen Ellyn. Upon becoming final, an order of the Hearing Officer may be appealed in the DuPage County Circuit Court via a judicial review, within thirty-five (35) days.

How to Pay your Administrative Adjudication Judgment

  • The Judgment Total must be paid in 21 days.
  • You may pay the Cashier’s counter by cash, check or credit card OR
  • Pay by check via U.S. Mail - include a copy of the Findings, Decisions & Orders judgment form and make check payable to the Village of Glen Ellyn

  • No credit card payments can be processed via U.S. Mail or over the phone.
  • NOTICE: Failure to pay your fine within twenty-one (21) days will result in a late payment penalty of fifty dollars ($50.00). Failure to pay within each subsequent twenty-one (21) day period will result in an additional penalty of thirty dollars ($30.00). If unpaid, the judgment will be referred to a Collection Agency and the Village may seek other legal action.
